Mangomonkey.com.au is owned and operated under licence from Mango Monkey Designs Pty Ltd and is here in referred to as ‘the website’ and/or ‘the site’. Access to the website is subject to the user’s acceptance and agreement with the terms, conditions, notices and disclaimers contained herein. Use of, and/or access to, the website constitutes agreement to the Terms of Use. The Website Owners reserves the right to amend the Terms of Use at any time. Since users are bound by the Terms of Use, they should periodically refer to them. The most recent version will always be found here.
Your digital images remain your property. Mango Monkey is designed to provide a private, secure place for you to convert your favourite photos into quality printed products and gifts. We retain your photos only to facilitate the production of your chosen products and to allow re-ordering within a 1 month period. After one month from placing your initial order, we will delete your images from our server unless you place another order in that timeframe from which the one month period begins again.
We are not liable for any copyright infringement. Mango Monkey assumes at the time of order that all relevant permissions have been obtained to allow the use of the images you upload onto our site.
Your personal information is protected. Your privacy is important to us and we take great care to protect it. Your personal details will remain the confidential property of the site owners and will not be intentionally sold or given to any third party unless ordered by a court of law. Your information will be used to process orders and to advise you of new products and promotions. Please see our Privacy Policy for details.
We may communicate with you via email and/or telephone. You consent to receiving such communications from Mango Monkey. Mango Monkey intends to send regular email updates and occasional promotional offers that may be of interest to you. You may opt-out of these mailings at any time upon receipt.

Registration
When you register as a user of the Mango Monkey website, you agree to our Terms and Conditions in their entirety. As a registered user, you will be able to upload images on to our website, order products from our catalogue and expect to receive communications regarding our products from time to time.
Delivery Method and Charges
Mango Monkey will take all precautions to ensure your product(s) arrive safely and promptly. Your order will be posted via Australia Post. Postage and handling costs may vary depending on the size/weight of your order. Mango Monkey holds no responsibility for delayed, lost or damaged parcels. Express Post or Registered mail can be arranged with additional costs. Please email us after you place an order if you would like to arrange express postage.
International Orders
Mango Monkey is happy to deliver world wide. We will contact you with a delivery quote.
Colours
Please note final colour(s) will be as close as possible to the artwork that appears on this website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be exactly the same as the final purchased product.
Return/Refund Policy
We know you will love what you have ordered. We offer a 10-day money back guarantee for the quality of our photo products ordered through our website. This guarantee is for the satisfaction with the quality of our printed products. Please note we will not be held responsible for inappropriate picture or poor image quality.
If the item is returned, it must be in its original condition. We cannot accept returned items that show any signs of wear, abuse or alteration. The return courier/postage charges will be at your expense.
Simply follow the instructions below to return the item.
Email us via info@mangomonkey.com.au to obtain a unique Return Authorisation (RA) number. You MUST have a RA number to make a claim.
Write the RA number clearly on the shipping label or outside of the package.rap the product securely in a protective shipping container together with a copy of the invoice.
Use your own courier at your own expense.

IMPORTANT:
Mango Monkey reserves the right to refuse to refund to any customer the price of their printed photo product if:
- It is not returned within 10 days of receipt by customer.
- There is evidence of use and wear of the item.
- It is a custom designed item.
- The reason is not related to quality issue.
Once we receive your package, we will credit your credit card or send a cheque as your refund within 1 week.
Restrictions on use of content and intellectual property the web site
All materials, text, graphics, information, software and advertisements on the web site is Copyright and belongs to Mango Monkey. The content is protected by International and Australian trademark and copyright laws. The contents of the web site is published in real-time, must not be copied, reproduced, modified, republished, uploaded to a third party, transmitted, posted or distributed in any way, electronically or otherwise, without the express authorisation of Mango Monkey. The web site must not be used in any manner or for any purpose, which is unlawful, or in any manner which violates any right of Mango Monkey or a partner or member or which is prohibited by the Terms of Use.
Limitation of liability and Disclaimer
The Trade Practices Act and similar State and Territory Legislation in Australia, may confer rights and remedies on the user in relation to the provision by Mango Monkey of goods or services on the web site which cannot be excluded, restricted or modified ("Non-excludable Rights"). The site does not exclude any Non-excludable Rights but does exclude all other conditions and warranties implied by custom, law or statute. Except as provided for by the Non-excludable Rights:
a) all Content is provided "as is" and without warranties of any kind, either express or implied,
b) Mango Monkey expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose,
c) Mango Monkey does not warrant that the functions contained in any content or any public interface or user access to the web site will be uninterrupted or error-free, that any defects will be corrected or that the web site or the server which stores and transmits content to the user are free of viruses or any other harmful components,
d) Mango Monkey does not warrant or make any representation regarding the users access to, or the results of the users access to, the web site (including any related or linked websites) or any content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise, and
To the fullest extent permitted by law, Mango Monkey’s liability for breach of any implied warranty or condition which cannot be excluded is limited at the option of Mango Monkey to the following: in the case of services supplied or offered by Mango Monkey, (a) the supply of the services again, or (b) the payment of the cost of having services supplied again; and in the case of goods supplied or offered by Mango Monkey, (c) the replacement of the goods or the supply of equivalent goods, (d) the repair of such goods, (e) the payment of the cost of replacing the goods or acquiring equivalent goods, or (f) the payment of the cost of having the goods repaired.
Termination
These terms and conditions are effective until terminated by Mango Monkey. This agreement and users’ access to the website may be terminated at any time without notice.
In the event of termination, users are no longer authorised to access the web site, but all restrictions imposed on the user, licenses granted by the user and all Mango Monkey disclaimers and limitations of liability set out in the Terms and Conditions will survive.
Miscellaneous
Mango Monkey relies on the user's continued observance of these Terms of Use. If Mango Monkey suffers any loss or damage or incurs any costs in connection with any breach of these Terms of Use or any other legal obligation then the user agrees to indemnify Mango Monkey for those losses, damages and costs. This agreement will be governed by and construed in accordance with the laws of NSW Australia, where Mango Monkey is hosted. The user irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of the Australian Capital Territory. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement, which will continue in full force and effect. All rights not expressly granted herein are reserved.
